Terms and Conditions

These Terms and Conditions govern your use of CertTrack, a workforce certification tracking platform operated by Clearworkers (Alex Welstad). By creating an account or using CertTrack, you agree to these terms. If you don't agree, please don't use the service.

1. Account registration

To use CertTrack, you must create an account with accurate and complete information. You are responsible for:

• Keeping your login credentials secure and confidential
• All activity that occurs under your account
• Notifying us promptly if you suspect unauthorized access

You must be at least 18 years old and authorized to bind your company to these terms when registering on behalf of an organization.

2. Acceptable use

CertTrack is built for construction companies to manage worker certifications, equipment inspections, and job site compliance. You agree to use it only for lawful purposes and in accordance with these terms.

You may not:

• Upload false, fraudulent, or misleading certification records
• Use the platform to harass, spam, or harm workers or other users
• Attempt to gain unauthorized access to other accounts or systems
• Reverse engineer, copy, or resell any part of the platform
• Use automated tools to scrape or extract data from the service

We reserve the right to suspend or terminate accounts that violate these rules.

3. Payment and refunds

CertTrack is available on a free tier with limited features, and paid subscription tiers with expanded capabilities. Paid plans are billed through Stripe.

• Billing: Subscriptions are billed monthly or annually in advance. Your card on file will be charged automatically at each renewal.
• Cancellation: You can cancel your subscription at any time. Access continues until the end of the current billing period; we do not prorate partial periods.
• Refunds: We do not offer refunds on subscription fees already charged, except where required by law. If you believe a charge was made in error, contact us within 30 days at awelstad@gmail.com.
• Price changes:We may change subscription prices with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.

4. Your data

You own your data. Any certification records, worker information, documents, or other content you upload to CertTrack belongs to you or your organization. We do not claim ownership over it.

By using CertTrack, you grant us a limited license to store and process your data solely for the purpose of providing the service to you.

You are responsible for ensuring you have the right to upload and store the data you submit, including obtaining any necessary consents from workers whose information you enter into the platform.

5. SMS notifications

CertTrack sends automated SMS messages to workers about expiring certifications on behalf of their employer organization.

Employers are responsible for ensuring workers have consented to receive SMS notifications before adding their phone numbers to CertTrack.

6. Limitation of liability

CertTrack is provided "as is." We make no guarantees that the service will be uninterrupted, error-free, or meet every specific requirement you have.

To the fullest extent permitted by law, Clearworkers and Alex Welstad shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, revenue, or business opportunities
• Compliance failures resulting from missed, incorrect, or late certification alerts
• Actions taken based on information displayed in the platform

Our total liability to you for any claim arising from use of CertTrack shall not exceed the amount you paid us in the three months preceding the claim.

CertTrack is a tool to assist with compliance tracking — it does not guarantee regulatory compliance, and it is not a substitute for your own safety management obligations.

7. Termination

You may close your account at any time by contacting us or through your account settings. Upon termination, your access to the platform will end and your data will be retained for a short period before deletion, in accordance with our Privacy Policy.

We may suspend or terminate your account without notice if you violate these terms, engage in fraudulent activity, or if we are required to do so by law. In cases of non-payment, we will attempt to contact you before suspending access.

8. Changes to these terms

We may update these terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. For significant changes, we'll notify you by email. Continued use of CertTrack after changes take effect means you accept the updated terms.

9. Governing law

These terms are governed by the laws of the State of Idaho, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of CertTrack shall be resolved in the courts of Idaho.
